Question about Payout for UMI

Has it been completely settled that payout is from well to well or can the oil company charge for all eight wells before a UMI receives any money? In talking to our lawyer yesterday, he indicated that there was still some question on the matter. Is there case law? Comments please.

Thanks KB- We had read the Zink case and wondered about that when our attorney made comment. Can you refer me or post a link to the statute and LOC rulings?
