Prescription. State of Louisiana Mineral Code- Articles 159 - 163.. My abridged and condensed layman's version. The conveyance of mineral rights without the accompanying surface estate creates a servitude. That servitude confers the right to explore for and produce minerals for a ten year period. That ten year period may be interrupted by attempts to produce or the actual production of the minerals. At the cessation of operations resulting in no production or the end of production of those minerals, the ten year prescription period begins again. At the end of an uninterrupted ten years of non-production with no attempts at establishing production, the mineral servitude expires and the mineral rights revert to the surface owner.
