Hi again, we are using a lawyer from Lufkin Tx by the name of Rebecca Brightwell.... she is wonderful!! I am trying to find out for my brother in law about his land , its about 36 acreas.

Yes Shelly we do own the surface rights. As for the well is old it was here when we purchased the property so no we've never been paid anything. It was capped off years ago, long before we were here. If I'm not mistaken the mineral rights are probated just as any real property is when someone dies. But what if there was no will and what if like other property in Texas if there is no lien it just automatically goes to next of kin or do the mineral rights go back to the state of Texas. I wonder if there is a "found mineral" rights like there is for "found money" maybe through the Texas Comptrollers office. I'm sure we need to just call Ken Muckelroy (Attorney) in Center and ask him. I think the consult call is free. I tried last week but he hasn't gotten back to me yet.

OK I understand! My brother owns some land and not the minerals right. We were also wondering to about the people who owns them... They have both past now and trying to find out if there is any other family... not sure. I wonder if not , what happens... So if you find anything out please let me know and if i find out something i let you know... Take Care!

Hello Snetx, I am from San Augustine TX... You own the land , right! So don't you have surface rights. I think I thought you said you have a pipe going across your land. Where you pd for the surface.. Need to check it out. Take Care and Good Luck!!!!!!!!
