the potential for production, at least using new techniques is IMHO, is one of the reasons I question this application.  If the Woodbine/Subclarksville is truly "non productive" in the area, I'm less concerned, but I would rather see it in a depleted reservoir of some sort.  

I don't know the details on subsurface trespass, but my expectation is that a lot of that lies with the mineral owner around that 10 acres, and the consideration that the target formation is not productive.  You may want to contact Ben Elmore, one of the Texas O&G lawyers that frequents this site to see if he can explain it to us.  

There will be a fairly substantial bond required for facility closure, and there will be requirements on well integrity testing (MIT) with the RRC.  RRC is in charge of everything except noise, traffic, and air emissions.  Again, I'm not so opposed to injection per say, but in a rural area, one has a great deal of latitude in locating it as far from homes as possible.  If I were an adjacent landowner, my primary concern would be surface spills and leaks, not so much the subsurface aspects.

  I will attempt to contact Ben as I believe that property and mineral legal rights might be at Question here ----------- I can see that a disposal well out in the middle of a very large tract of land might not be any of our business but to allow a commercial operation on a very small sliver of land is kind of short sighted on the part of the RRC

I just noticed this thread and thought I would chime in.  If the intended target formation is potentially productive, then you have to protest before the RRC and present evidence in support of your protest.  There are lawyers who specialize in practicing before the RRC (that's all they do), and most are located in Austin.  With respect to subsurface trespass, our Supreme Court recently approved of fracing across lease lines requiring the injured mineral owner to prove actual damage to the formation or reservoir to recover for the subsurface trespass.  Otherwise, there are no damages and therefore no claim of trespass.  The same analysis would probably apply to disposal wells.  If the injected fluids crosses lease lines, you are going to have to prove some injury or damage to the reservoir or formation to prevent it, especially if the disposal well is shown to provide a benefit to the oil and gas activity going on in the area.

  While protesting to the the RRC will the BURDEN OF PROF lie with the objectors ?

  FYI --- this area has NOT been depleted nor does it have any well control and is on a major State Hwy so waste products will be trucked in etc. for now

Yes, the burden is on the protestor to supply evidence in support of the grounds for protest.

We have mineral rights in the area northwest of Austonio. We are still in talks on a lease with Terrace Energy. Asked the Landman if Terrace was building the disposal well in the area he said he didnt know anything about it but wanted to know why I was asking. We have around 80 acres. I am just seeking information from a mineral rights owner perspective. Alot of the information here is above my head but I do find it interesting. Would love to see more aerial shots of rigs in the area.

 The area NW of Austonio is a good place to be are you in the Albright?

 Dbob, jffree ------ The Parten Rig is still standing today and the Western Chief well has a head on it that is red and green and looks more like a old fire plug than a Christmas Tree-- seems to be very large diameter but not very tall ----- never have seen one like it before ------- noted that XTO amended their H well to a vertical.

Hadn't noticed the change to vertical.  Navidad added a couple of permits today.  One Madison, One Houston County.  

Re red and green well head - that might be some type of connector intended for fracing or other completion work.  Different equipment/operations will use a different stack.

 That is where Terrace has just permitted a well ---- suggest you go to the Houston co RRC  W1 and open the plat and jot down the Lat Long and then put these # in Google Earth and see how close it is to your minerals

  Looks like the Famous Gibbs Bro. #1H by RANGE (Walker Co.) is having an offset drilled to the East this one is called the Apollo Energy Gibbs Bro. #1H -they have been drilling for 14 days and are down >6000'

  In Houston county Parten is still drilling ahead so is the rig on the I Lopez  ----- Navidad is ALREADY RIGGING UP on Eastham Prison

  Only one left drilling in Angelina right now is Goodrich

    Hearing that some leasing may start in San Jac Co. so it looks like Boscoe's predictions of the fever started by the RANGE WELL in Walker is spreading to the East.

I understand there is another horizontal well in Walker County on Scales Ranch Road.  I am not sure of the status.  I have two tracts of land in Walker County being looked at by two land men representing two different companies.  Neither land man is interested in the other tract of land.  One has offered $100 per acre for a 200 acre tract and the other has offered $200 acre for our share of a 800 acre tract.  I am wondering if it would be best to wait on the production numbers of the Scales Ranch and/or Gibbs wells to maybe negotiate a better price.  My concern is that if the wells do not produce the land men with pack up and not want to lease.  Any advice?
