I was wondering if u live in the city limits of town should u have your mineral rights on your land?

Depends on the wording in your deed. When surface ownership is conveyed minerals are included unless there is a specific reservation. In town. Out of town. Doesn't matter. The conveyance document controls. However a reservation of minerals in LA constitutes a servitude which is effective for 10 years. If no attempt to produce the minerals the ownership reverts to the owner of the surface after the 10 years. If you bought a home and the builder or seller reserved the minerals and 10 years passed without a well being drilled including those minerals than the mineral ownership would be yours.
thanks reason for asking is that I was looking at some sights that there arguing over the water says that there using up the town water causing the wells to dry up so i was trying see do i need to get my paper work in order . an find out whats my rights. thanks for the info
Charles what area are you in? In most communities, oil and gas use is minor compared to other water use. groundwater law and regulation varies between Texas and Louisiana, and within certain areas.
