What happens if spouse's name and signature are left off a Oil & Gas Lease?

What happens if, through a series of transactions, minerals which were once seperate property become community property and the landman hired by the Oil and Gas company apparently misses it? The lease was signed by only one spouse a year ago and that name is the only one that appears on the lease. In the meantime the minerals were sold to a third party who discovers the error. Would an undivided 1/2 of the minerals be unleased? It would seem the buyer would be able to count on the public record.

SB--Do you know any of people involved? A simlar situation occur with one of my 1st cousins (grandchildren)they simply let the other lease be left unratified-invalid and signed new lease. This occurred with grandfather to grandchildren heirs in a will minerals first left to stepmother but on her death the minerals go to grandchildren a lease that was sign by step mother but not sign by grandchildren since stepmother was keeper of minerals for grandchildren until her death the operator offered the grandchildren small bonus to reatify lease and they denied offer so new lease done.
I know them very well!
SB--Think I would talk to them to see what wishing of everyone is -- if they(your friends) are sellers I think I get COG to prepare papers for lease to be ratified so they will not to take any chance of COG could requested refund of bonus money because lease went with minerals on sell and they(sellers) have nothing to gain by not ratifying since they have sold the minerals. If your friends are the buyers I would get competing bid for lease to pressure COG to offer buyer new lease with better terms as you said bonus free to sweet the offer for new lease.
who does not want to talk COG who has lease (which I thing is not valid unless ratified by both spouses) or new buyer and new owner of minerals.
HARDAGE--- you miss it somewhere because I was agreeing with you 100% --Two Dog continue with a what if question about the wife running off---I agree it has been beaten to death enough and I understand what you said and it is correct law in Texas and SB has his answer I am sorry you miss that somewhere. THANK YOU YOUR KNOWLEDGEABLE INPUT AND EDUCATION FOR SITE
adubu, you are taking the ball and running in a different direction. I have no wife that owns crap of what I got. All I was saying is that the wife didn't have crap to do with the oil lease.
