I leased with Porter working for Chesapeake back in July. I had a good Exibit A. They had me sign the lease and the Exibit A page. On the lease there was a place for them to sign but on the copy they gave me no one signed for them- only my wife and I signed it.
On the exibit A page there was just a spot for me and my wife to sign and it said "for identification only" where we signed the exhibit a.
The Porter folks did not sign anything.
With reading about all the underhanded stuff the oil companies and leasing agents do I wonder if they could just throw away the exhibit a page and act like it never existed. There was a spot in my lease pages where it said that if the language in the lease conflicted with exhibit A then exhibit A would overide the language in the lease or something to that effect.
I have heard that Porter and Chesapeake were some of the more straightforward honest companies to deal with.
How can I find out if they threw away my addendum page or if it is with the lease as it should be?

On the first page of the lease it should say SEE EXHIBIT "A" ATTACHED HERETO FOR SPECIAL PROVISIONS. The Porter group is not going to stoop to that, they have been in buisness too long to commit blatant fraud.
I agree with Two Dogs and Jim. The surest way to make sure you are ok is to get a recorded copy of the lease at the clerk's office.

It would be a VERY bad thing for them to remove an Exhibit A so I think you are probably ok.
Are copies of the actual leases filed or is it a memorandum of lease - which just records that you and such-and-such O&G have a lease on such-and-such tract? I've usually just seen memorandums not copies of the actual lease.
Not true..Petrohawk and CHK are still filling memorandums.
memorandums are used for several reasons, to cut down on recording costs, and to keep the unleased and competetion from seeing all the terms agreed to in the lease.

I also signed with Porter and Chesapeake the whole thing was done through our attorney, so I know all the lease was correct. We signed in September and we still have not recieved payment and our lease has not been filed. We have talked to Porter and they tell us our lease is good and it
is now in Cheasepeake's hands we were given a man to contact at Cheasepeake and he has not returned any of our calls. We are simply dumbfounded at the fact they are not telling us they won't
honor the lease, but they will not return our calls or our attorney's. So we are left wondering are they going to pay. They will not tell us.
Sorry to hear your having such problems. Ours was fairly easy to do. Was done back in about July. It was supposed to be 30 day bank draft but took about 50 days because the Porter.CHK bank said our bank did not send them all needed info the first time they sent it in.

I had a land man friend who works for a small company and was not involved in HS leases in my area at the time. He wrote a good addendum page for me and striked a bunch of the stuff from the Porter standard lease. Thank God I did not have to deal with a devil (aka lawyer).

I hate frickin Lawyers!!!!!! I've probably had to deal with about 15 in my life for a variety of things from working for me and against me in lawsuits, to my kids friends with theirs, to my kids playing sports with their kids, to buying a 4 wheeler from one and of all them I have only ever met two who I did not think they were total DICKHEADS within about 5 minutes of meeting them. The guy who handled an adoption for me and the guy who I bought the 4 wheeler from seemed like nice fellas. The rest of the LAWYERS were TOTAL DICKHEADS!!!!!!!!!
Now I may have talked with a lawyer on Go Haynesville Shale who was a nice person. If I did talk to you and you were a lawyer and a good person then that makes three Lawyers I've talked to that were not total dickheads.

I'm puzzled. Realize that things were moving pretty fast in HS country this past year, but why did your attorney not hold the executed lease until such time as the draft(s) were paid?
Because I did not have an atty.. I hate all those DICKHEADS.

Thanks for everyone's advice, thoughts and input. I think I'll do this. I'll start by contacting Porter.
