Thanks, buckmaster. I find that the value of well pad locations has remained relatively constant regardless of fluctuations in lease bonus offers. I still think that many members do not understand the significant value of surface locations. Most of those that have negotiated good surface agreements have had professional assistance.
Does this mean the surrounding wells in the adjacent sections will have the same problem or is this strictly an error during drilling fraccing and not related to the field's or area's viability?

The best case to get is a "no surface use" clause. Then you don't have to negotiate anything else.
If you cannot get this, then the most important thing is to ensure you have a strong indemnity clause. This is language that will protect you, in the event your driller causes any damage. These damages can occur to workers, nearby landowners, etc. You want to make sure you are not at any risk from the driller's accidents or screw-ups.
There are many other things you could/should ask for. But I'm not the best to advise you. You might want to start a discussion on the main board, where you'll get a wider audience and response.
My last advice is think in terms of the next 100 years... You want to ensure that when the last well is plugged and abandoned, the operator restores the land. You don't want your great, great grandchildren to have to deal with an expensive eyesore. If you don't write it in the lease, I promise you that your land will not be restored. It will be left with rusting fences, dangling power lines, and broken equipment.
