What if some members pay their portion, is there anyway to get that money back, or is it just a lost?
How do the oil companies handle paying out once a succession is done? Will they just start paying every heir or will they just pay the ones who contact them??

We all are supposed to split the cost for the lawyer to do the succession.
Or do you mean if there is money that the heirs are entitled to get. Only royalties.
If there is money use it to pay for the probate proceedings.

Ken, what state are we talking about? Louisiana is different than Texas.
However, today being Saturday and the day set aside for College Football most of our members are occupied elsewhere. You can get a lot of good help here, but you might have to bump your own post since it's the weekend, and not all GHS members are here.
Until then, do a search for past posts and threads on the topic - but the state is very important (I am not a lawyer, just a older fellow who has already buried lots of loved and not so loved relatives.)

This isn't a hypothetical question on the family problem, right?
In other words, the circumstances you describe are truly happening in real time, i.e., in your own family, is that correct?
And, y'know, if so -- then my question to you would be "why" do some in the family not want to pay their share to have the succession done? Tell us the "why" of their motivations (as best as you understand it). That might help shape a more defined response from GHS members.
Also, give us the numbers. Is it only two people out of ten relatives, or is it say 8 cousins out of a large family of 12 relatives? Is there bad blood? Is this a fight over the inheritance of an estate and how some in the family are unhappy at the division of the heirship? Also, what's a rough estimate on the cost of succession? If you don't know, you can guess.

There are about 15 heirs who has not turned in their share. There is one main relative who is older who is the problem. He just wants to be difficult. I don't know the reason. He is on the outs with maybe 2 of the heirs. And he also lives in a state with about the other 14 heirs who won't turn in their share.
He told some of the heirs that they were not heirs and that he was the sole and only heir. Which is a bold face lie. And he didn't feel that the deceased relatives' children should get anything. Well, it's a good thing he doesn't get paid to think.
A rough cost of the succession is about $26000K, i think.
That would be 15 out of 53 heirs that is causing a problem.
I want to know if we pay their portion, can we legally get that money back?
Once the succession is done, do each person call up the company for themselves to get their money. Or is it that once one person contact the company, the company will start issuing checks to all of the heirs?
