Penelope -

I think we will need a bit more information - I assume you currently have property on Lake Bistineau and had hoped to received royalty payments on said property in the near term.  Based on the documents you provided, it appears that Louisiana is trying to lay claim to some of the area that was encompassed by the Bistineau OHWM after 1812, and the federal government is claiming title to lands that may have had an OHWM arrising after 1812.  Is your property part of that claim?

Do you know the chain of title for your property going back to 1812?

dbob, I am a novice at this gas business and I really don't know beyond the fact that I am a mineral rights owner. Thank you for your reply

Penelope

First suggestion is to find or obtain a map that shows where your mineral interest is in relation to the claims in this case.  If you are anywhere close (e.g. within a 0.10 of a mile) you probably need to dig in more detail.  You'll probably want/need the services of a professional landman or oil and gas attorney familar with title work.

Thank you dbob

Shame all of KB's dialog is gone.

Yep.  We lost a lot of good content and it leaves gaping holes in discussion threads.

Skip, in your minds eye how long could something like this take best and worst case. Thank as always for your input.

penelope, that's a question for an O&G attorney.  I am not sufficiently familiar with the suit to comment.

Penelope,  I am no expert in this, but I do trust the people on this board to give novice members (like me) good advise.  I encourage you to stay active on here, continue to ask questions and do consult the legal pros they advise.  Sometimes we have to spend money to make money or save assets.  This could be too important to you and your family.

.

This board can be a good support for you.  No one can give you good online advice but by reading posts here you can gauge the consensus of seasoned professionals and what they would do in your shoes.  Sometimes their advice has been too technical for me to understand but there is always someone who can translate it :)

Question for Penelope.  is Petrohawk suspending all of your acreage based on the Bistineau suits or just the acreage beyond what would be the furthest inland high water mark of contention between the State and Fed?

HPB my understanding is that the acreage beyond is in contention. But this is still taking a big bite out of my share. I am digging back to see if my rights were bought from the state or  United States
